These Terms and Conditions ("Terms", "Agreement") constitute a legally binding contract between you ("User", "you", "your") and Atlas Academy ("Platform", "we", "us", "our"), a trading education and community platform operated by Atlas Aegis from the Republic of Kenya. By registering an account, accessing any content, or using any feature of the Platform, you acknowledge that you have read and understood these Terms and agree to be bound by them in their entirety.
1. Educational Purpose and Mandatory Financial Disclaimer
ATLAS ACADEMY DOES NOT PROVIDE FINANCIAL ADVICE. ALL CONTENT IS STRICTLY EDUCATIONAL.
1.1 Nature of the Platform
Atlas Academy is a trading education platform. All content published on the Platform — including strategy roadmaps, DeepDive technical analysis modules, community feed posts, group chat messages, chart markups, trade breakdowns, session analyses, Order Block annotations, Liquidity Sweep frameworks, ICT methodology guides, Daily Bias explanations, Smart Money Concepts material, leaderboard performance data, and any other educational material — is provided for informational and educational purposes only.
1.2 No Financial Advice
Nothing on the Platform constitutes, or should be construed as, financial advice, investment advice, trading advice, a trade signal, an investment recommendation, or any solicitation to buy or sell any financial instrument. The methodologies discussed are presented as educational frameworks only, and their discussion does not imply they are profitable, reliable, or suitable for any specific trader.
1.3 User Assumption of Risk
You assume one hundred percent (100%) of the risk and responsibility for all trading decisions you make on any live, demo, prop firm evaluation, or other trading account. Atlas Academy and its operators expressly disclaim any liability for financial losses, drawdowns, failed evaluations, margin calls, or other adverse outcomes arising from your use of educational content on this Platform. Past educational examples are not indicative of future results.
1.4 Regulatory Compliance
Users are solely responsible for ensuring their trading activities comply with the laws of their jurisdiction. Atlas Academy makes no representation that its content is appropriate or legally permitted in all countries.
2. Intellectual Property Rights
2.1 Platform Ownership
All intellectual property on the Platform is the exclusive property of Atlas Academy or its licensors, including the source code, architecture, curriculum design, DeepDive content, leaderboard algorithms, visual designs, branding, and proprietary database schemas.
2.2 Prohibited Actions
You are strictly prohibited from copying or redistributing Platform content without authorisation; reverse-engineering or decompiling the Platform; scraping or harvesting data by automated means; intercepting or reverse-engineering API traffic or authentication flows; cloning the Platform's architecture or frameworks; or removing proprietary notices.
2.3 Enforcement
Violations may result in immediate account termination, civil legal action, injunctive relief, and claims for damages and legal costs under Kenyan law, international copyright treaties, and applicable foreign law.
3. User-Generated Content and Community Conduct
3.1 Licence Grant
By submitting content to the Platform ("User Content"), you grant Atlas Academy a perpetual, irrevocable, non-exclusive, royalty-free, worldwide licence to use, display, and distribute it within the Platform for operating community features. You retain ownership but warrant you hold all rights necessary to grant this licence.
3.2 Content Standards
User Content must not constitute financial advice or solicitation; be defamatory, abusive, or discriminatory; contain spam or unauthorised promotional links; infringe third-party IP; contain malware or phishing links; involve unauthorised data collection; or violate applicable law.
3.3 Prohibited Technical Conduct
You must not flood or stress-test Platform infrastructure; bypass authentication or rate-limiting; exploit vulnerabilities; impersonate other users or staff; or operate multiple accounts to evade bans or manipulate leaderboard standings.
3.4 Moderation
Atlas Academy reserves the right, at its sole discretion, to review, edit, remove, or decline to display User Content without notice or liability. Moderation decisions are final.
4. Account Registration and Termination
4.1 Account Requirements
You must be at least eighteen (18) years of age to create an account. By registering, you represent that you are of legal age and that all information provided is accurate.
4.2 Termination by Atlas Academy
Atlas Academy reserves the absolute right, at its sole discretion, to suspend or terminate accounts, revoke access, remove User Content, and permanently ban users — without prior notice, refund, or liability — for conduct determined to violate these Terms or harm the Platform, its users, or its commercial interests.
4.3 Termination by User
You may close your account at any time by contacting us. Certain data may be retained as required by law or legitimate operational purposes, in accordance with our Privacy Policy.
4.4 Effect of Termination
Clauses 2 (Intellectual Property), 5 (Limitation of Liability), and 6 (Governing Law) survive termination of this Agreement.
5. Limitation of Liability
5.1 Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. ATLAS ACADEMY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
5.2 Cap on Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ATLAS ACADEMY SHALL NOT BE LIABLE FOR FINANCIAL OR TRADING LOSSES, PROP FIRM CHALLENGE FAILURES, LOSS OF PROFITS OR DATA, BUSINESS INTERRUPTION, PLATFORM DOWNTIME, ACTIONS OF OTHER USERS, OR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
5.3 Indemnification
You agree to indemnify and hold harmless Atlas Academy from claims, liabilities, and expenses arising from your use of the Platform, your User Content, or your violation of these Terms or third-party rights.
6. Subscription, Payments, and Access Tiers
Atlas Academy may offer free and premium subscription tiers. Fees are processed through third-party payment processors and stated in the applicable currency at time of purchase. Atlas Academy reserves the right to modify pricing with reasonable notice. Fees for commenced subscription periods are generally non-refundable except as required by consumer protection law — see our Refund & Cancellation Policy for full details.
7. Third-Party Services
The Platform uses third-party infrastructure including Supabase (database and authentication) and Cloudflare (network security and routing). Atlas Academy is not responsible for the availability, performance, or conduct of these services, which are also subject to their own terms and privacy policies.
8. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes by updating the effective date above and, where practicable, via in-app notification. Continued use after changes take effect constitutes acceptance.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Disputes shall first be subject to good-faith negotiation; if unresolved within thirty (30) days, disputes shall be submitted to the jurisdiction of the courts of the Republic of Kenya. Users in other jurisdictions acknowledge that accessing this Platform constitutes voluntary submission to Kenyan law for matters arising from their use of the Platform.
